Agreement
TuchPilot is operated by Nehemiah Armstrong ("TuchPilot," "we," "us"), without a separate registered legal entity at this time. These terms govern your use of TuchPilot's automation software ("Pilots"). By creating an account or using TuchPilot, you agree to these terms. If you're using TuchPilot on behalf of a business, you're agreeing on that business's behalf and confirming you're authorized to do so.
What TuchPilot does
TuchPilot connects to accounts you already have — a business phone number (via Twilio), a payment processor (Square), and/or a Facebook Page (via Meta) — and automates specific, well-defined tasks on top of them: texting back missed callers, generating quotes from a price list, collecting deposits, and drafting/publishing social media posts. TuchPilot never creates or controls the underlying accounts it connects to; you remain the account holder with those providers at all times, and can disconnect TuchPilot from any of them whenever you choose.
Your account and responsibilities
- You're responsible for the accuracy of any pricing, business information, and content you upload or confirm.
- You're responsible for keeping your login credentials secure and for activity that happens under your account.
- You must have the rights to any content (images, price lists, business information) you upload for TuchPilot to process or publish.
- You won't use TuchPilot to send unlawful, deceptive, or abusive communications, or to publish content that violates Meta's or any connected provider's own policies.
Text messages and opt-out
If a Pilot sends automated text messages on a business's behalf (for example, the Missed-Call Text-Back Pilot), a recipient can reply STOP at any time to stop receiving further texts from that business through TuchPilot — this is recorded and enforced automatically, right away. Replying HELP returns a short message with more information. Message and data rates may apply.
SMS Terms — Missed-Call Text-Back customer-care program
This program is TuchPilot's Missed-Call Text-Back customer-care program: when someone calls a connected business's number, TuchPilot first plays a complete automated disclosure in full — "TuchPilot can send up to four customer-care texts about this call. Message and data rates may apply. Reply STOP to opt out. Consent is not required to purchase, and your call will still be forwarded if you decline." — and only after that disclosure has finished playing does it ask, "Press 1 to agree, or stay on the line to continue without texts." A key pressed while the first, complete disclosure is still playing is not collected by the phone system at all and cannot register as a response to anything; only a "1" pressed during the second question is recorded as consent. The call is forwarded to the business either way. Only if the caller pressed 1, and the forwarded call then goes unanswered, does TuchPilot send that caller one automated text on the business's behalf, continuing the conversation only if the caller replies. This is a low-volume customer-care use, never a marketing or promotional campaign, and TuchPilot does not purchase, rent, or import phone number lists for it.
Consent. Consent to receive a text is captured directly by TuchPilot, from the caller themselves, at the moment described above — an affirmative keypress ("press 1") made only after the caller has heard the complete disclosure, before any text is ever sent. TuchPilot does not treat the act of calling a business's number, by itself, as consent to receive text messages: a caller who doesn't press 1 — whether they press nothing, press a different key, or hang up during either message — still has their call forwarded normally and simply never receives a text. Consent is not required as a condition of purchasing any goods or services from a connected business.

- Carrier delivery is not guaranteed — T-Mobile, AT&T, Verizon, and other carriers are not liable for undelivered or delayed messages.

AI-generated content
Some Pilots use AI to draft text messages, extract pricing, or generate social media captions. AI output can be wrong. Pricing extracted from a document is never used until you explicitly confirm it; social media posts are never published without your review unless you've explicitly enabled Auto-Publish mode for that Pilot, in which case you're accepting responsibility for reviewing your posting settings and content guidelines rather than each individual post.
Payments
Deposits and balances collected through the Payment Pilot are processed entirely by Square under Square's own terms; TuchPilot never holds or transmits card details and is not a party to the underlying payment between you and your customer. TuchPilot's own subscription fees are billed separately, as described at signup.
Service availability
TuchPilot depends on third-party providers (Twilio, Square, Meta, OpenAI, and our hosting infrastructure) that are outside our control. We'll make reasonable efforts to keep the service available and to communicate known outages, but we don't guarantee uninterrupted availability, and we're not responsible for outages or failures originating with a connected third-party provider.
Termination
You can pause any individual Pilot at any time from your dashboard — this stops that automation immediately, keeps its data and history intact, and you can turn it back on whenever you choose. Canceling your account entirely — ending your subscription and disconnecting TuchPilot from your connected providers — isn't yet a self-serve action; contact us (see "Contact" below) and we'll take care of it for you. We may suspend or terminate an account that violates these terms, misuses a connected provider's platform (which can itself put your underlying Twilio/Square/Meta accounts at risk with those providers), or engages in abusive or unlawful activity.
Disclaimer and limitation of liability
TuchPilot is provided "as is," without warranties of any kind. To the fullest extent permitted by law, TuchPilot is not liable for indirect, incidental, or consequential damages arising from your use of the service, including losses caused by a connected third-party provider's outage, policy change, or account action.
Changes to these terms
We may update these terms as the product changes. We'll update the "Last updated" date above, and for material changes, we'll notify account owners directly.
